Acceptable Use Policy

This Acceptable Use Policy ("AUP") sets out the rules for using the FileFlippers™ platform at fileflippers.com ("Platform"). This AUP is incorporated into and forms part of our Terms of Service.

1. General Principles

FileFlippers™ is designed for the lawful transfer, enhancement, and conversion of files. We expect all users to use the Platform responsibly and in accordance with applicable law.

2. Prohibited Content

You must not upload, store, share, or transfer Content that:

2.1. Contains child sexual abuse material (CSAM) or any material that exploits, sexualises, or endangers minors. We have a zero-tolerance policy. We act on any report, hash match, or law-enforcement notice: access is blocked, evidence is preserved, your Account is terminated without notice, and the matter is reported to the relevant authorities, including the National Crime Agency (NCA) and, where applicable, the National Center for Missing and Exploited Children (NCMEC).

2.2. Promotes or incites terrorism, violence, or hatred against any individual or group based on race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, or any other protected characteristic.

2.3. Contains malware, viruses, ransomware, spyware, trojans, worms, or any other malicious or destructive code.

2.4. Infringes the intellectual property rights (copyright, trademark, patent, trade secrets) of any third party.

2.5. Contains personal data of third parties shared without their consent, including doxxing, revenge pornography, or non-consensual intimate imagery (prohibited under Section 33 of the Criminal Justice and Courts Act 2015 and the Online Safety Act 2023).

2.6. Facilitates or promotes illegal activities, including but not limited to drug trafficking, weapons dealing, money laundering, or fraud.

2.7. Contains phishing content or material designed to deceive others into revealing personal information or credentials.

2.8. Constitutes spam or unsolicited bulk communications.

2.9. Contains instructions, designs or digital files for making firearms, firearm parts, ammunition, explosives or other weapons. That includes files made for 3D printing or machining them, whatever format they come in.

2.10. Is terrorist content, or supports, promotes or raises money for an organisation proscribed in the UK under the Terrorism Act 2000.

2.11. Is any of the kinds of content the Online Safety Act 2023 (section 61) calls "primary priority content that is harmful to children":

• (a) pornographic content, meaning content of such a nature that it is reasonable to assume it was produced solely or principally for the purpose of sexual arousal. Text on its own is not included;
• (b) content which encourages, promotes or provides instructions for suicide;
• (c) content which encourages, promotes or provides instructions for an act of deliberate self-injury (self-harm);
• (d) content which encourages, promotes or provides instructions for an eating disorder or behaviours associated with an eating disorder.

This applies to every user on every plan, and everywhere on the Platform: files, share and download pages, previews, review comments, pins and drawings, branding, file names, transfer titles and notes. A password or a payment gate makes no difference, so you can't sell pornographic content through a payment-gated link either. Accounts are for adults, but share links can be forwarded to anyone, including children. That's why these four kinds are banned outright rather than hidden behind an age check.

Talking about suicide, self-harm or eating disorders is fine when the content doesn't encourage, promote or give instructions for them. Support and recovery material, news, education, medical information and art are all allowed.

For photographers and other creative work. We follow Ofcom's guidance on what counts as pornographic. It's judged on the content itself and its context, not on what the person sharing it says it's for.

Allowed, when the main purpose is something other than sexual arousal:

• fine art nudes, life drawing, painting and sculpture;
• boudoir, glamour, lingerie and swimwear work that is suggestive rather than explicit;
• fashion and editorial shoots;
• film, TV and theatre stills or clips where nudity or sex is part of the story and not shown in graphic detail;
• documentary and journalistic images, including breastfeeding;
• medical, clinical and educational images, including anatomy and intimate examinations;
• sexual wellness products shown as products, not in use.

Not allowed:

• explicit sexual activity, such as masturbation, oral sex or penetration;
• images or video that focus on genitals, breasts or buttocks, or show full frontal nudity, in order to arouse;
• fetish material that shows exposed genitals, breasts or buttocks;
• explicit sexual audio;
• any of these drawn, animated or made with AI.

One set can contain both. A boudoir shoot is fine, but an explicit image within it is not. We won't treat lawful nudity in work like this as obscene or objectionable just because it contains nudity. If we reasonably believe content falls under this section, we may remove it or block access without notice and suspend or close the Account involved (see section 5). Section 8.15 of our Terms of Service sets out the same rule.

3. Prohibited Conduct

You must not:

3.1. Attempt to gain unauthorised access to the Platform, other users' Accounts, or our infrastructure.

3.2. Probe, scan, or test the vulnerability of our systems without written authorisation.

3.3. Interfere with, disrupt, or overload the Platform (including DDoS attacks or resource abuse).

3.4. Use automated tools (bots, scripts, crawlers, scrapers) to access the Platform without our prior written consent.

3.5. Circumvent or attempt to circumvent any security measures, access controls, rate limits, or usage restrictions.

3.6. Resell, redistribute, or sublicense access to the Platform or Services.

3.7. Impersonate any person or entity, or falsely represent your affiliation with any person or entity.

3.8. Use the Platform to facilitate the violation of any applicable law or regulation.

3.9. Use the Platform if you are, or act on behalf of, an organisation proscribed in the UK under the Terrorism Act 2000. If we have reasonable grounds to believe an Account is run by or for such an organisation, we will remove it.

4. Storage & Bandwidth Limits

4.1. Each plan has defined storage and transfer limits. Exceeding these limits may result in temporary restriction of Services.

4.2. We reserve the right to implement rate limiting and bandwidth throttling to ensure fair use across all users.

4.3. Artificially inflating storage or bandwidth usage (e.g. storing data unrelated to file transfer) is prohibited.

5. Enforcement

5.1. We may investigate suspected violations of this AUP. We reserve the right to:

• Remove or disable access to Content that violates this AUP.
• Suspend or terminate Accounts that violate this AUP.
• Report illegal activity to relevant law enforcement authorities.
• Cooperate with law enforcement investigations.

5.2. We aim to provide notice before taking action, except where:

• We are legally prohibited from doing so.
• The violation involves CSAM, terrorism content, or imminent harm.
• The Content falls under section 2.11.
• Notice would compromise an investigation or create risk of harm.

5.3. If you believe your Account has been suspended or your Content removed in error, contact support@fileflippers.com.
